Description

A Kaithal teenager, currently in judicial custody for heinous crimes like attempt to murder and dacoity for his alleged role in the January 26 violence, may have won some relief for himself and several others. In a judgment that may help farmers held in various jails, Metropolitan Magistrate Abhinav Pandey has ordered the Delhi Police to furnish an FIR to Deepak’s lawyers. Deepak (19), lodged in Tihar Jail, was arrested on January 26 from Nangloi, near the Tikri border, but his family was not notified. His father Ramesh, after finding his son’s name on the list of those arrested in the aftermath of the January 26 violence, visited the Nangloi police station and sought a copy of the FIR, but his request was turned down. After a request in writing for a copy of the FIR was rejected, a petition was filed in court.“We moved court on February 9, saying a copy of the FIR was our right. The judge passed an order in our favour. We received a copy of the FIR today,” said lawyer Aadil Singh Boparai. He said the judgment would bring relief to many who had been held.“Not giving a copy of an FIR is a curtailment of basic rights. The judge has asked for a clarification for failing to give us a copy of the FIR. We have to understand that counsel of the accused cannot move a bail application without a copy of the FIR,” he added. — TNSDad had sought copyDeepak’s father Ramesh, after finding his son’s name on the list of those arrested, visited Nangloi police station and sought a copy of the FIR, but his request was turned down
